The Telephone Consumer Protection Act (TCPA)
The TCPA is a federal law that allows consumers to sue businesses for statutory damages ranging from $500 to $1,500 per unsolicited call or text. Businesses cannot make unsolicited phone calls or text messages with the use of an autodialer or the use of an artificial voice or prerecorded message without prior express written consent from the consumer.
Defenses to TCPA
There are various defenses to TCPA claims including consent, the lack of an autodialer, and more. Under the recent U.S. Supreme Court decision in Facebook v. Duguid, your equipment may not be an autodialer. Depending on the facts alleged in the lawsuit, the Wu Law Office may be able to file a motion to dismiss. Contact the Wu Law Office today.
